Terms & Conditions

Last updated: 8 April 2025  |  Effective date: 8 April 2025

1. Definitions

In these Terms, the following terms have the meanings set out below:

2. Acceptance of Terms

By accessing this website, you agree to be bound by these Terms. If you do not agree, please discontinue use of the website. These Terms apply to your use of the website only. The provision of legal services is governed by the separate written Agreement issued to you before work begins.

Our services are available to individuals who are 18 years of age or older and who have the legal capacity to enter into binding agreements under Malaysian law.

3. Website Use

This website is provided for informational purposes. Nothing on this website constitutes legal advice. Information about our services, fees, and process is provided in general terms only. The specific application of law to your circumstances depends on facts that have not been assessed through a website visit alone.

You may use this website for lawful purposes only. You must not use it in a manner that disrupts its operation, attempts to gain unauthorised access to any system, or transmits harmful or misleading content.

4. Enquiry Handling

An enquiry submitted through the website form does not constitute an engagement, and we are not obliged to respond to every enquiry. A formal legal engagement begins only when a written Agreement has been issued by us and accepted by you. First enquiries are treated as exploratory and do not give rise to a solicitor-client relationship until a written Agreement is in place.

5. Intellectual Property

All content on this website, including text, layout, and design, is the property of Beholdr or its content suppliers. You may view and print pages for your own personal, non-commercial use. You may not reproduce, distribute, or adapt any content without our prior written permission.

6. Fees and Payment

Fees for the advisory and interpretation services are as stated on our solutions page. These are fixed fees in Malaysian Ringgit (RM), inclusive of the scope described. Fees for probate representation are quoted per engagement based on the scope of the matter. All fee arrangements are set out in writing in the Agreement. Invoices are issued in accordance with the Agreement and are payable within the period stated therein.

7. Service Terms — Legal Services

Scope

The scope of each legal engagement is defined by the written Agreement. We do not undertake work outside that scope without a written variation agreed by both parties. If the scope changes materially, we will issue a revised scope and fee arrangement for your approval.

Our obligations

Your obligations

8. Confidentiality

We maintain strict confidentiality over all client information and communications. This obligation survives the termination of any engagement. We may disclose client information only where required by law, court order, or the applicable rules of professional conduct, or with your written consent.

9. Disclaimers

This website is provided on an "as is" basis. We make no representation that the website is free from errors or that it will be available at all times. Information on the website reflects the general position at the time of writing and may not reflect subsequent legal developments.

Legal outcomes depend on the particular facts of each matter and on circumstances outside our control. We do not provide any assurance of specific outcomes in any engagement.

10. Limitation of Liability

To the maximum extent permitted under Malaysian law, our liability to you in connection with the use of this website (as distinct from the provision of legal services, which is governed by the Agreement) is limited to direct losses actually incurred. We are not liable for indirect, consequential, or incidental losses arising from use of or reliance on the website.

Nothing in these Terms limits our liability for matters that cannot be limited under applicable law, including liability for gross negligence or fraud.

11. Termination

Either party may terminate a legal engagement on reasonable notice in accordance with the terms of the written Agreement. Upon termination, you remain liable for fees in respect of work completed prior to termination. We may retain copies of documents as required by our professional obligations.

12. Dispute Resolution

We encourage any concern about our services to be raised with us directly in the first instance. We will seek to address it promptly. If the matter cannot be resolved informally, disputes are subject to the jurisdiction of the Malaysian courts and governed by the laws of Malaysia. The Bar Council of Malaysia provides a complaints process for matters concerning professional conduct.

13. General Provisions

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be indicated by an updated date at the top of this page. Continued use of the website after a change is published constitutes acceptance of the updated Terms.
