Ambiguous residuary clause, three beneficiaries
The situation
A family of three adult children were co-executors of their mother's estate. The residuary clause of the will referred to property that had since been sold and reinvested. The children disagreed about how to proceed and sought external interpretation before involving the court.
The work
Beholdr read the will in full and reviewed correspondence from the original solicitor. A written note was prepared explaining how the residuary clause should be read, grounded in the relevant statutory provisions and case principles, and drafted in a form all three co-executors could read and respond to.
The outcome
The note resolved the question to the satisfaction of all three co-executors. The estate was administered without court involvement. The engagement was completed within three weeks of the documents being provided. Fee: RM 1,280.
Family Business Advisory — Johor, 2024
Succession planning for a manufacturing SME
The situation
The founder of a small manufacturing company in Johor was approaching his late sixties and had two children with different levels of involvement in the business. His existing will had been drafted before the business existed in its current form and did not address the shareholding.
The work
Beholdr reviewed the business structure and the existing will over three sessions with the founder and, separately, with each child. Estate planning options were set out in writing, and after a period of reflection within the family, the founder instructed us to prepare an updated estate planning arrangement that addressed the business shareholding explicitly.
The outcome
The engagement produced a written advisory summary and updated estate documents. The process took approximately ten weeks. The founder noted that the process had produced conversations within the family that should have happened years earlier. Fee: RM 3,180.
Probate Representation — Johor Bahru, 2023–2024
Contested grant of probate, sibling dispute
The situation
A grant of probate was challenged by one of four siblings on the basis that the deceased lacked testamentary capacity at the time the will was executed. The remaining three siblings, represented by Beholdr, sought to uphold the will.
The work
Beholdr prepared the affidavit evidence, instructed a medical expert, and managed correspondence with the opposing party throughout. Written updates were provided after each court date. The proceedings lasted approximately nine months before reaching a resolution.
The outcome
The matter was settled without a full hearing, on terms that the clients found acceptable. The relationship between the four siblings, while strained, remained intact. The engagement concluded within the originally estimated fee range.
